Motor Vehicle Accidents: Cars and trucks do not cause damages, only people do. But it sometimes takes a lot of lawyer time to resolve who is responsible for damages when people become involved in accidents. Bad Faith/Punitive Damages: Where one side has substantially more opportunities to control a transaction or situation, and there is a public policy reason to ask them to act fairly, that may be bad faith. And if one side takes advantage through fraud, oppression or malice, the law says they may be punished by an award for more than compensation for injuries. Litigation Defense: When someone assumes responsibilty without legal advice, it usually comes without a thoughtful and fair consultation with an experienced attorney. Negligence: Negligence is failiure to exercise reasonable care resulting in injury to someone and/or damages to property. Personal Injury: Generally, a claim that one or more persons have negligently injured someone. It could also include reckless or intentional acts resulting in injury. Premise Liability: Generally, a claim that someone is negligently injured on the property owned by another party. Product Defect: Generally, a claim that a unreasonably dangerous product has injured someone, Negligence is not required. |
